Parliament’s Imperative: Purging Pernicious Laws

Opinion 21/06/2024Sunil GarnayakBy Sunil Garnayak3 Mins Read

The newly elected Indian Parliament faces a crucial opportunity to rectify legislative missteps of the past decade. Numerous laws enacted under the previous administration have sparked widespread controversy and pose significant threats to citizen rights.

Citizenship Amendment Act: A Recipe for Disenfranchisement

The Citizenship Amendment Act (CAA), combined with the proposed National Register of Citizens (NRC), has ignited fears of mass disenfranchisement. The disastrous pilot project in Assam, where a significant percentage of residents were excluded from the final NRC list, amplifies these concerns. A nationwide implementation could render millions stateless.

Criminal Law Bills: Erosion of Fundamental Freedoms

The recent Criminal Law Bills, hastily enacted, warrant urgent reassessment. Provisions on marital rape and sedition, along with the criminalization of dissent against police directives, raise alarms of creeping authoritarianism. These laws demand meticulous scrutiny and broad-based consultation to safeguard fundamental freedoms.

Marital Rape Exception: An Archaic Anomaly

The marital rape exception in the Bharatiya Nyaya Sanhita, rooted in outdated English laws, perpetuates the notion that wives lack bodily autonomy. This provision contradicts the fundamental principle that rape is a violation of personal integrity, regardless of the relationship between the perpetrator and victim.

Sedition: Suppression of Dissent Under a New Guise

Despite claims of its removal, the essence of sedition persists in the Bharatiya Nyaya Sanhita under the guise of “endangering sovereignty.” This vaguely defined offense, contrary to the Law Commission’s recommendations, threatens to stifle dissent and peaceful protest.

Other Contentious Laws

The Chief Election Commissioner and other Election Commissioners Act, 2023, and the Mines and Minerals (Development and Regulation) Amendment Act, 2023, also warrant scrutiny. The former grants the Union government undue control over the appointment of election commissioners, while the latter raises environmental concerns due to its provisions on mining exploration.

Transgender Persons Act: Inadequate Protection

The Transgender Persons (Protection of Rights) Act, 2019, fails to adequately protect transgender women from sexual violence. The law’s lenient punishment for sexual abuse compared to the penalties for rape of cisgender women is discriminatory and requires rectification.

Aircraft Act: An Antiquated Anachronism

The Aircraft Act, 1934, with its outdated definition of aircraft, serves as a humorous reminder of the need for legislative modernization. While amusing, it underscores the importance of regularly reviewing and updating laws to align with contemporary realities.

In Conclusion

India’s new parliament has a unique opportunity to repeal or amend laws that undermine democratic values and jeopardize citizen rights. By doing so, it can reaffirm its commitment to justice, equality, and liberty for all.
