The court highlighted the stark contrast between the pensions received by District Judges, often amounting to a mere ₹15,000 per month, and those of High Court Judges, who typically receive ₹30,000 per month upon retirement.

The court also acknowledged the unique social and financial circumstances of District Judges. Unlike High Court Judges, they rarely have access to lucrative arbitration opportunities after retirement, further compounding their financial vulnerabilities. This disparity in post-retirement prospects adds to the urgency of addressing their pension grievances.

Collaboration for a Resolution

In a bid to find a swift resolution, the Supreme Court urged the Attorney General and Solicitor General to collaborate with the amicus curiae and explore viable solutions. The court emphasized the need for a comprehensive approach that takes into account the specific needs and challenges faced by retired District Judges.

Progress and Challenges in Implementation

While several states have complied with the Second National Judicial Pay Commission (SNJPC) recommendations on pension arrears and retirement benefits, the Supreme Court expressed its displeasure over the lack of compliance in other regions.
